Guards at the New Mexico State Penitentiary in Santa Fe discovered the body of a Taos man convicted of murder in 2003 in his cell early Monday morning (Jan. 21).
Nathaniel Durán, 23, hanged himself with a bed sheet around 3 a.m. and was discovered in his maximum security cell as prison guards conducted a count. Joni Brown, state penitentiary deputy warden, said every effort was made to resuscitate Durán.
“He was in a level-six super-maximum security facility, which means that he had a single cell with solid door and a small window,” Brown said. “He was found unresponsive sitting on the desk with a sheet around his neck and paramedics pronounced him dead at 5 a.m.”
Durán was serving a life sentence in the 2002 rape and murder of 36-year-old Marioara Shand. Shand’s body was found July 9, 2002 in her Ranchos de Taos apartment she rented from Durán’s grandparents. Shand had been raped, stabbed 14 times, her throat had been cut twice, according to testimony by Taos County Sheriff’s deputies at Durán’s 2003 trial.
A receipt found in Shand’s apartment showed that she had been shopping around 8:20 p.m. July 6, 2002. Durán’s friends testified at the trial that Shand picked Durán up in her car the morning of July 7, the same morning Shand did not show up for work at 8 a.m.
DNA taken from semen samples from Shand’s inner thigh linked Durán to the crime. Durán, who was 17 at the time he was charged, admitted to having consensual sex with Shand, but denied any allegations that he had anything to do with Shand’s death.
A jury convicted in 2003 on charges of first degree murder, criminal sexual penetration and tampering with evidence. He was sentenced in March 2004 to life in prison plus 101⁄2 years. At his sentencing, Durán reportedly ripped off his shirt and began screaming obscenities.
In the weeks prior to Shand’s murder, Durán had taken a plea bargain with the state for charges relating to a home invasion. A court records check also revealed that in October Durán had filed a civil suit against the New Mexico State Penitentiary challenging his confinement conditions.

Little doubt he would have continued his life of violent crime if not arrested for this rape/murder. In that respect, catching him at a young age saved lives and the pain victims' families endure when the killer is not identified for years or decades. Story is complete for the criminal justice system. The pain slowly fades for those who loved Marioara, but the void left by her death remains.
